May 5th 2008 11:19PM Um, T-Mobile is a GSM carrier in the US.
Also, the exclusivity agreement may have only applied to the first-generation iPhone, not to the 3G product. If AT&T didn't notice/negotiate for that, then Apple surely can release the new phone unlocked, if they so choose. None of us have read the agreement and know what it contains.

Apr 9th 2008 9:41PM Yeah, it's funny because PC Office & Mac Office aren't compatible anymore (Mac Office can't open VBA macros) and that Mac Office is absolutely abysmal. Office 2004 in Rosetta *and* Office 2007 in VMWare both launch faster than the "native" Office 2008.

Apr 8th 2008 2:13PM Wow, there is a ton of misinformation in this comments thread:
a) The "illicit" 2.0 firmware is the same (identical md5sums) as the "real" 2.0 firmware I have access to as part of the dev program.
b) There are tools, public tools, that let you install it without having to worry about the PSOD
c) If you have the illicit firmware installed with those tools, your phone will be working fine, whereas legit developers are the ones who's phones aren't working now.
d) The 2.0 firmware is laughably buggy and extremely slow. It isn't worth hacks to get it on your phone unless you need it to develop apps.

No, obviously not. Every time some fucking Apple fanboy leaps up to defend their decisions to charge for firmware updates with "it's big bad SOX boohoo boohoo" it really pisses me off. MSFT gave away the entire featureset of the Zune 2 to Zune owners. TiVo perpetually gives away features in firmware updates to people with lifetime subscriptions which were amortized away years ago. If you have an STB from your cable provider, Motorola or Scientific Atlanta enable new features even though they realize the sale of the box all at once.
There is nothing in Sarbox that says "You have to do asinine half-accounting bullshit and charge for firmware updates." The section that people generally cite to justify this behavior is title 4§401(b): "... Pro forma financial information ... filed with the Commission ... shall be presented in a manner that (1) does not contain an untrue statement of a material fact or omit to state a material fact necessary in order to make the pro forma financial information, in light of the circumstances under which it is presented, not misleading; and ... [paragraph 2 is about using GAAP]"
That's it. The interpretation is whether saying "We realized all the profit from the sale of this widget when it was shipped even though there will be a firmware update in the future" is misleading or not. For anyone with even an elementary level of familiarity with the hardware market, that assertion is not misleading and would not be advantageous to Apple to misstate. SOX is not a defense for this, it's greed, pure and simple.
