Supreme Court rejects T-Mobile appeal over contracts
Just a day after hearing that T-Mobile lost its magenta suit against Telia, more bad news on the legal front has been handed down to the carrier. Just this week, the Supreme Court decided to reject T-Mob's appeal in a trifecta of cases "involving the legal remedies available in millions of cellphone contracts." Each case centered around the same issue: "whether state laws that limit the ability of companies to prohibit consumers from banding together to pursue class action lawsuits are preempted by federal law." In layman's terms, T-Mobile had attempted to ban class actions and require its customers to resolve any gripes via arbitration, which clearly didn't pan out so well. However didn't the Supreme Court reject State's Right's over medical marijuana? I thought I remembered something like that. If so, very hypocritical of the court.
I agree with the decision, because class action bans only favor the company and shaft consumers. I'm just saying that SCOTUS may be inconsistent.

Well, if you are talking about the US:
Federal law trumps state laws.
However, there are limits on federal law: It can only cover specific areas, such as interstate commerce (what that exactly means is a topic of frequent debate, but is used to justify federal anti-drug laws and environmental regulations).
Congress CAN, however, "encourage" states by way of economic incentives (e.g. transportation fund) to behave in certain ways.

No love for T-Mobile and quickly soaking up reject on a federal and state leve. Ouch. I lost all respect I had for them when they let me down on their turtle-like rollout of 3G, and not to mention their phone selection. I paid my ETF after being loyal for 4 years and skipped to AT@T. I have no regrets.

Dear Slowskys, Please accept my humble apologies. I, in no shape or form, meant any disrespect. I have a high regard for turtles, in fact I had a pet turtle well over 2 decades ago. It had a club hoave, and diabetes, yet surprising faster than Slow Mobile. I meant T-Mobile. I guess in my original statement, i was referring to the my pet turtle, named .... Mr. Slow Mo. that's what I refer t-mobile as.
