i wouldnt doubt it if you would be allowed to. its not like the phone was subsidized.

currently, if you are already in a contract you can still get the iphone. dont see why the second would be any different. its just more like a "purchase" than an "upgrade." The term upgrade usually implies some type of discount. you can go into any att store and just purchase a phone and put your sim in it.
